Anti-Spam Commitment

With Canada’s Anti-Spam Legislation and its relevant rules and regulations (“CASL”) coming into effect on July 1, 2014, the Employer Services division of Fast2eat is committed to providing transparency to outside parties with respect to our compliance with CASL.

This Fast2eat Canada Anti-Spam Commitment is a formal statement of rights and obligations made available to outside parties, such as you. It is intended to inform you about (a) the responsible and transparent practices adopted by Fast2eat when electronically communicating with outside parties, (b) who you may contact at Fast2eat for any concern pertaining to our electronic communications, and (c) where and how you may unsubscribe from receiving commercial electronic messages from Fast2eat.

This document also includes a series of answers to questions about spam and Fast2eat’s practices.

Why are you receiving electronic messages from Fast2eat?

Like most Canadian businesses today, Fast2eat sends various electronic messages to outside parties in the normal course of doing business. Although not an exhaustive list, the most common types of electronic messages we generate include:

Messages from Fast2eat Marketing or Sales teams sent to current or potential clients (whether individuals or businesses) for prospecting purposes, to promote new Fast2eat products and services, to share industry news and provide thought leadership, or to respond to a request for information or an inquiry;

Messages from one of Fast2eat’s operations sent to current or potential service providers seeking a third party’s services or messages from Fast2eat’s HR department to contact potential candidates electronically for recruitment purposes.

Messages sent to current or potential new business partners relative to commercial arrangements.

Messages sent by our service delivery teams and other Fast2eat Associates to current clients in the context of delivering the Fast2eat services that our clients have purchased.

Not all of these messages are subject to CASL, and not all types of messages may require your consent. Most importantly, if you are a current client of Fast2eat, you will continue to receive electronic messages sent to you in the normal course of delivering the Fast2eat Services you or your company have purchased, as they are exempt under CASL.

Application and scope

This Anti-Spam Commitment generally applies to any commercial electronic messages (“CEM”) sent by Fast2eat to outside parties. It is protected by a range of business procedures, processes and policies to ensure that such communications are done in compliance with CASL. Fast2eat, in its electronic communications with Canadian outside parties, has to comply with the rules established by CASL and enforced by the Canadian Radio-television and Telecommunications Commission, the Competition Bureau and the Privacy Commissioner of Canada. CASL regulates all CEM, which are messages that include, among their purposes, the encouragement of participation in a commercial activity.

What is Fast2eat doing to comply?

Fast2eat has adopted this Anti-Spam Commitment to provide transparency to outside parties with respect to the compliance of the organization’s electronic communication practices with CASL, as well as undertaken, amongst others, the following initiatives:

Fast2eat CASL-compliant consent forms. The consent of outside parties is necessary for Fast2eat to send a CEM. This consent typically must be “express,” but in certain circumstances, consent can be “implied,” and in others, messages are specifically exempt from consent requirements. Fast2eat has modified certain consent forms to ensure that recipients’ express consent is in compliance with CASL. You can have your email address removed from Fast2eat’s mailing lists at any time. However, even if you unsubscribe from receiving CEM from Fast2eat, you may still receive electronic messages from Fast2eat which relate to an ongoing business relationship or are exempt under CASL.

Fast2eat email footers. Fast2eat has modified its email footers to manage CASL’s consent requirements. Under CASL, all CEMs sent must include certain prescribed content. For example, Fast2eat must clearly identify Fast2eat as the party sending the CEM, provide a method whereby the recipient can readily contact Fast2eat, such as a mailing address and one of (i) a telephone number with active response voicemail, (ii) an email address, or (iii) a web address; and provide a working unsubscribe mechanism. Consequently, CASL-compliant email footers have been updated on all email communications (emails and mass mailings) sent from Fast2eat to ensure compliance with CASL.

Fast2eat unsubscribe mechanisms. Fast2eat has incorporated unsubscribe mechanisms into all CEMs, to manage CASL’s consent requirements. Under CASL, each CEM must provide a working unsubscribe mechanism, which must be processed within a maximum of 10 business days. Consequently, Fast2eat has set up a uniform process to ensure that all unsubscribe requests will be complied with. You may at any time unsubscribe from receiving CEMs from Fast2eat by following the process laid out in the electronic message you receive or by contacting unsubscribe@fast2eat.com. However, even if you unsubscribe from receiving CEM from Fast2eat, you may still receive electronic messages from Fast2eat which relate to an ongoing business relationship or are exempt under CASL.

Why are you receiving a CEM from Fast2eat?

Types of CEMs Fast2eat may send you from time to time could include the following:

CEM is sent to Fast2eat’s current or potential clients (whether individuals or businesses) by Fast2eat’s marketing department, business development or operation team. For example, this may be for prospecting purposes or to answer a request for information or an inquiry;

CEM is sent to Fast2eat’s current or potential service providers by various Fast2eat business units. For example, Fast2eat may outsource part of its activities to a third party or, the Fast2eat HR department may contact potential employees electronically for recruitment purposes.

CEM sent to Fast2eat’s current or potential business partners.

If you have received a CEM from Fast2eat and believe that you should not have received it, please assess whether you have provided consent to receive CEMs from Fast2eat or if an exemption applies.

Express Consent: You may have provided your express consent through a Fast2eat communication or consent form.

Implied Consent: Fast2eat may infer your implied consent if:

Fast2eat has an existing business relationship with you and/or your organization or has a former business relationship with you and/or your organization that terminated less than two years ago (for instance, if you and/or your organization are a former client);

Fast2eat received an inquiry from you within the last 6 months;

You disclosed your electronic address to a Fast2eat employee (for example, you provided your business card to a Fast2eat employee), or you conspicuously published your electronic address (for example, via a corporate website or in a brochure), and the CEM sent is in connection with your business role and function.

When is an electronic message exempt under CASL?

If you are receiving electronic communications from Fast2eat, it may be a message that is exempt under CASL. This would be the case if the message is one of the following:

  • you have a personal relationship with the Fast2eat employee who contacted you, meaning that you have previously had direct, voluntary, two-way communication;
  • you have a family relationship with the Fast2eat employee who contacted you;
  • the CEM is sent within Fast2eat (between employees of Fast2eat);
  • the CEM is sent between Fast2eat and another business (including Fast2eat’s strategic partners), where there is an ongoing relationship between Fast2eat and this other business;
  • the CEM was sent by Fast2eat to you to respond to your request or inquiry; or
  • the CEM was sent by Fast2eat to you to enforce a legal right or obligation (for instance, if you have outstanding debt or breached a contract that you have with Fast2eat or an obligation toward Fast2eat, etc.).

In certain situations, your consent is not required for certain types of messages sent by Fast2eat, although you may still unsubscribe from the future transmission of similar messages. The type of message where Fast2eat does not need your consent is an electronic message that:

  • is sent once, following a referral by a current Fast2eat client, service provider, business partner or employee who also has a personal or business relationship with you;
  • only provides you with a request for a quote or an estimate;
  • only facilitates or confirms a transaction;
  • only provides safety or security information; or
  • only provides information about:
  • your ongoing use of Fast2eat services or ongoing purchases;
  • a Fast2eat service purchased (including updates and upgrades).

If you have received a message that you believe is a CEM, and you should not have, please forward this email to unsubscribe@fast2eat.com, and we will address the situation (within 10 business days).

Social media

Fast2eat employees may contact you via social media, such as LinkedIn if you are connected on the social network with the Fast2eat employee. If you have indicated through your preference settings, you are open to receiving messages about new business opportunities or ventures. You may also be contacted if you have conspicuously published your electronic address (for instance, on a social media website), have not indicated that you did not wish to receive CEM, and the CEM sent is connected with your business role and function.

What do you do if you no longer wish to receive CEM from Fast2eat?

At Fast2eat, we take the respect of laws very seriously. You may unsubscribe at any time from receiving CEMs, by following the process in the email footer or by contacting unsubscribe@fast2eat.com, and we will remove you from our mailing list within ten (10) business days.

Amendment of this anti-spam commitment

From time to time, Fast2eat will review and update this Anti-Spam Commitment as required to keep current with rules and regulations, new technologies, standards, our business practices and outside parties’ concerns. We will post any Anti-Spam Commitment changes on this page. If the changes are significant, we will provide a more prominent notice (including, as the case may be, email notification of Anti-Spam Commitment changes).
