You are not required to sign up for an Account to use certain portions of the Services. However, certain service features, such as uploading recipes and creating menu planning, favourite recipes and shopping lists, require you to register for an Account.

You are solely responsible for the activity on your account and keeping your Account password secure. You must immediately notify Fast2eat of any unauthorized or suspicious uses of your account. Fast2eat will not be responsible or otherwise liable for any acts or omissions by you or anyone else with access to your account, whether such access is authorized or unauthorized.

To register and create an Account, you must select a valid email account and password, provide certain personal information requested by the registration form (the “Registration Data”), and promptly update the Registration Data thereafter as necessary.

In consideration of the use of the website’s services, you agree to (a) provide Fast2eat with truthful, accurate and pertinent information about yourself as prompted by the registration form, (b) maintain and promptly update the personal information you provide to keep it true, accurate, current and complete, (c) that you are not barred from using the Services under any applicable law, (d) that you will be responsible for all activities that occur under your account, (e) to monitor your account to restrict its use by minors and other unauthorized users, and (f) notify Fast2eat immediately of any unauthorized use of your password or any other breach of the security of your account and to exit from your account at the end of each session.

You agree not to (a) create an Account using a false identity or alias, select or use as a username a name of another person with the intent to impersonate that person, (b) use as a username a name subject to any rights of a person other than you without appropriate authorization; (c) use, as a username, a name that is otherwise offensive, vulgar or obscene; or (d) share your account or password with anyone.

If you provide any information that is untrue, inaccurate, not current or incomplete, Fast2eat has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete. Fast2eat has the right to refuse any and all current or future use of the website (or any portion thereof). Users are liable for any incorrectness about such information.

You acknowledge and agree that you have no ownership or other property interest in your account and that all rights in and to your account are owned by and inure to the benefit of Fast2eat.

You may never use another person’s user account or registration information for the Services without permission.

You must notify us immediately of any change in your eligibility to use the Services (including any changes to or revocation of any licenses from state authorities), breach of security or unauthorized use of your account. You should never publish, distribute or post login information for your account. You shall be able to delete your account directly or through a request made to one of our employees or affiliates.

Fast2eat is not responsible for any breach of security of any user code. Fast2eat will not be liable for any injury, loss or damage arising from or relating to your failure to comply with any acts or omissions by you or someone else using your account and/or password. Fast2eat will not be liable for any unauthorized transaction entered into using your name and password.

Confidentiality

If you use this site, you are responsible for maintaining the confidentiality of your account and password and restricting access to your computer. You agree to accept responsibility for all activities under your account or password. If you are under 18, you may use our website only with the involvement of a parent or guardian. Fast2eat and its associates reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in their sole discretion.

Email

By registering through this website, users consent to receive emails, phone calls, SMS messages and/or any other means of communication necessary to keep users informed about their Account status or our services. Any communication from Fast2eat shall be deemed received by the user immediately after sending it. Users are responsible for keeping all means of communication with Fast2eat current. They shall be held liable for any damages that may arise if users do not comply.

Additionally, by registering, you consent to receive commercial email from us. If you do not wish to receive commercial emails from us, you may email us to unsubscribe@fast2eat.com, and we will remove your name from the email list.

Fees and Purchase Terms

Payment for all orders must be by PayPal, credit or debit card as stated on the website. Users acknowledge that they are authorized to use the credit card they provide Fast2eat. Before the purchase of any products through this website, users must provide Fast2eat with a valid credit card number and pertinent information such as credit card holder name, credit card number, credit card type, the date of credit card expiration and any activation numbers or codes needed to charge the card. If Fast2eat cannot charge the provided credit card, users will be declined the right to purchase any goods or services through this website. If any goods or services have already been provided, users agree to pay all amounts in full upon demand by Fast2eat. The method of payment is evaluated on a case-by-case basis.

Payment

You agree to pay all fees or charges to your account in accordance with the fees, charges and billing terms in effect at the time a fee or charge is due and payable. You also agree to pay all applicable taxes. You must provide PayPal (or any other payment gateway contracted by Fast2eat) with valid payment information regarding your orders. By providing Fast2eat’s payment gateway with your payment information, you agree that (i) Fast2eat’s payment gateway is authorized to immediately invoice your account for all fees and charges due and payable to Fast2eat hereunder, (ii) Fast2eat’s payment gateway is authorized to share any payment information and instructions required to complete the payment transactions with its third-party payment service providers (e.g., credit card transaction processing, merchant settlement, and related services), and (iii) no additional notice or consent is required for the foregoing authorizations. You agree to immediately notify Fast2eat and/or Fast2eat’s payment gateway of any change in your payment information. Fast2eat reserves the right to change its prices and billing methods at any time. If payment cannot be charged to your payment card or your payment is returned for any reason, Fast2eat reserves the right to either suspend or terminate your access to the unpaid-for services.

Automatic Renewal

You will be notified during the process if your order is subject to automatic renewal. The automatic renewal and cancellation terms provided during the order process are hereby incorporated into this agreement.

Refunds

Please note that once you have made your order and your payment has been authorized, you will not be able to cancel your order, nor will you be entitled to a refund unless otherwise specified herein. Except in any separate refund policy posted on the Services, all fees are non-refundable.

Discounts, Promo Codes, and Premium Offers

In our sole discretion, we may create discounts and promotional codes that may be redeemed for credit in your account or other features or benefits, subject to any additional terms that we establish per promotional code basis (“Promo Codes”). Promo Codes may only be used once per person. Only Promo Codes sent to you through official Fast2eat communications channels are valid. You agree that Promo Codes: (i) must be used for the intended audience and purpose and in a lawful manner; (ii) may not be duplicated, sold, or transferred in any manner or made available to the general public (whether posted to a public forum or otherwise), unless expressly permitted by us; (iii) may be disabled by us at any time for any reason without liability to us; (iv) may only be used pursuant to the specific terms that we establish for such Promo Code; (v) are not redeemable for cash; and (vi) may expire prior to your use. From time to time, we may offer special promotions (such as free premiums with purchase), associated with some of our products or Services. All promotional offers, including premium offers, may be discontinued at any time, without prior notice, at our discretion and are only available while supplies last or for the duration noted.

Reviews, Recipes, Comments, Emails and Other Content

Visitors may post reviews, comments, and other content and submit suggestions, ideas, comments, questions, or additional information, so long as the content is not illegal, obscene, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, or otherwise injurious to third parties or objectionable and does not consist of or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings, or any form of “spam.”

You may not use a false email address, impersonate any person or entity, or otherwise mislead as to the card’s origin or other content. Fast2eat reserves the right (but not the obligation) to remove or edit such content but does not regularly review posted content. If you do post content or submit material, and unless we indicate otherwise, you grant Fast2eat and its associates a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media. You grant Fast2eat and its associates and sublicensees the right to use the name you submit in connection with such content if they choose. You represent and warrant that you own or otherwise control all of the rights to the content that you post, that the content is accurate, that the use of the content you supply does not violate this policy and will not cause injury to any person or entity: and that you will indemnify Fast2eat or its associates for all claims resulting from content you supply. Availability of Content

We do not guarantee that any Content will be made available on the site or through the Services. Responsible Party for Content

You acknowledge that all content is the sole responsibility of the party from whom such content originated. This means that each user is entirely responsible for all content that the user makes available through the Services or otherwise provided to Fast2eat, whether online or offline and whether or not solicited by Fast2eat (“User Content”). Fast2eat has no obligation to pre-screen any content. You use all User Content and interact with other Users at your own risk. Without limiting the foregoing, Fast2eat reserves the right in its sole discretion to pre-screen, refuse, or remove any content. Fast2eat shall have the right to remove any content that violates this agreement or is otherwise objectionable.

Ownership of Your Content

Fast2eat does not claim ownership of any User Content you make available on the Services (“Your Content”). However, when you as a User post or publish Your Content on or in the Services, you represent that you have all of the necessary rights to grant Fast2eat the license. Except with respect to Your Content, you agree that you have no right or title in or to any content that appears on or in the Services.

License to Your Content

Subject to any applicable Account settings that you select, you grant Fast2eat and anyone authorized by Fast2eat an irrevocable, non-exclusive, perpetual, worldwide, royalty-free right and license to use, copy, display, publicly perform, transmit, modify, publish, distribute, make derivative works of, sublicense, and otherwise commercially and non-commercially exploit and use Your Content (in whole or in part) in any manner or medium now existing or hereafter developed (including print and electronic storage) and for any purpose. Ratings and Reviews

Ratings and reviews posted by Users on our Services are User Content that is not endorsed by Fast2eat and does not represent the views of Fast2eat. Fast2eat does not assume liability for ratings and reviews or claims for economic loss resulting from such ratings and reviews. Because we expect Users to maintain a high level of integrity with respect to ratings and reviews posted through the Services, you agree: (i) to base any rating or review you post only on your first-hand experience with the applicable business, product, or service; (ii) you will not provide a rating or review for any business, product, or service with respect to which you have a competitive, ownership or other economic interest, employment relationship or other affiliation; (iii) you will not submit a rating or review in exchange for payment or other benefits from any individual or entity; and (iv) your review will comply with the terms of this agreement. If we determine, in our sole discretion, that any rating or review could diminish the integrity of the ratings and reviews, we may exclude such User Content without notice.

You agree that submitting any ideas, suggestions, documents, and/or proposals to Fast2eat (“Feedback”) is at your own risk and that Fast2eat has no obligations with respect to such Feedback. You represent and warrant that you have all rights necessary to submit the Feedback. You hereby grant Fast2eat the right to use any Feedback in any way at any time without any additional approval.

The Fast2eat website or application may contain hyperlinks to other websites outside of Fast2eat’s control. Fast2eat has the right but not the obligation to edit or remove any activity or content on the Fast2eat website that links to or references a third-party website. The prohibited acts listed above are non-exhaustive. Fast2eat, in its sole discretion, reserves the right to review, edit and/or remove any Submissions. Notwithstanding the foregoing, you hereby agree to defend, indemnify and hold harmless Fast2eat and its licensors and their respective affiliates and each of their directors, officers, agents, contractors, partners, representatives, and employees from and against any loss, liability, threatened or actual claim, demand, damages, costs, and expenses, including reasonable legal fees, arising out of or in connection with your Submissions, and/or your breach any of the restrictions listed above.

Fast2eat will fully cooperate with any law enforcement authorities or court order requesting or directing us to disclose the identity or location of anyone posting any material in breach of these Website Terms.

Fast2eat reserves the right, in its sole discretion, to suspend or terminate your access to this site and prohibit any and all current and future use of this site (or any portion thereof) by you if you fail to comply with any term or provision of these Terms of Use or your use is harmful to the interests of another user of this site.

User Representations and Warranties

THE FOREGOING CAP ON LIABILITY SHALL NOT APPLY TO LIABILITY OF A FAST2EAT PARTY FOR (X) DEATH, TANGIBLE PROPERTY DAMAGE, OR PERSONAL INJURY CAUSED BY A FAST2EAT PARTY’S GROSS NEGLIGENCE OR FOR (Y) ANY INJURY CAUSED BY A FAST2EAT PARTY’S FRAUD OR FRAUDULENT MISREPRESENTATION.

Basis of the Bargain

THE LIMITATIONS OF DAMAGES SET FORTH ABOVE ARE FUNDAMENTAL ELEMENTS OF THE BASIS OF THE BARGAIN BETWEEN FAST2EAT AND YOU.
